1. Agreement

These Terms of Service (“Terms”) govern your use of TomDown (the “App” or “Service”), a mobile application that lets you browse the web and download videos to your device. By installing or using TomDown, you agree to these Terms. If you do not agree, do not use the App.

TomDown is operated in connection with TempTom. Questions about these Terms may be sent to [email protected].

2. What TomDown Provides

TomDown offers:

• An in-app web browser for visiting third-party websites.
• Tools to detect and download media from supported pages, subject to technical limits and site restrictions.
• Local management of download tasks and saved files on your device.
• Optional settings such as ad blocking in the browser, search engine selection, and data cleanup (cache, history, cookies).
• Optional TomDown Premium — a one-time in-app purchase that removes App-level advertising (see Section 8).

TomDown is a utility tool. We do not host, publish, or distribute third-party video content. Downloads occur between your device and third-party servers or services.

3. Your Responsibilities & Acceptable Use

You are solely responsible for how you use TomDown and for any content you access or download. You agree that you will:

• Comply with all applicable laws, including copyright, trademark, and platform terms of the websites you visit.
• Obtain any required permission before downloading, copying, or redistributing content that is not yours.
• Use the App only for lawful personal purposes.

You agree not to use TomDown to:

• Download or distribute pirated, unauthorized, or illegal content.
• Circumvent technical protections in violation of law or a site’s terms.
• Harass, defraud, or harm others, or interfere with networks or services.
• Reverse engineer, scrape at scale, or abuse our backend APIs.

4. Third-Party Websites & Services

TomDown links to and loads third-party websites. We do not control, endorse, or review their content, privacy practices, or availability. Your use of third-party sites is governed by their own terms and policies. We are not liable for losses arising from third-party sites, broken links, changed formats, or removed content.

5. Accounts & Local Data

TomDown does not require you to create a TomDown account to use core features. Browser history, shortcuts, cookies, and downloaded files are primarily stored on your device, unless otherwise described in our Privacy Policy. You may clear browser data from within the App settings.

6. Service Availability & Changes

The Service is provided “as is” and “as available.” We may update, suspend, or discontinue features (including site-specific download support) at any time without notice. We do not guarantee that any particular website, format, or download method will always work.

7. Disclaimer of Warranties

To the fullest extent permitted by law, TomDown and its operators disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that downloads will be error-free, complete, playable on all devices, or free of malware from third-party sources.

8. TomDown Premium (One-Time Purchase)

TomDown may offer an optional one-time, non-subscription in-app purchase (“Premium” or “TomDown Premium”) that removes App-level advertisements (such as app-open ads shown by TomDown). Premium does not remove ads on third-party websites you browse unless you separately enable in-browser ad blocking.

8.1 Pricing & payment

Prices are shown in the App at checkout in your local storefront. Payment is processed by Apple (iOS) or Google (Android). We do not collect or store your full payment card details.

8.2 Lifetime access

Where offered as a lifetime product, Premium is intended to remain valid for the life of the App on supported platforms, subject to store and entitlement verification. If the App is removed from a store or substantially changed, access may be limited as permitted by platform rules.

8.3 Restore purchases

You may restore Premium on a new device using the same Apple ID or Google account via the in-app Restore function, subject to store policies.

9. Limitation of Liability

To the maximum extent permitted by law, TomDown, TempTom, and their operators, affiliates, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or business, arising from or related to your use of the App — even if advised of the possibility. Our total liability for any claim relating to the App shall not exceed the greater of (a) the amount you paid for Premium in the twelve (12) months before the claim, or (b) USD $10.

10. Indemnification

You agree to indemnify and hold harmless TomDown, TempTom, and their operators from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App, your downloads, your violation of these Terms, or your violation of any law or third-party rights.

11. Termination

You may stop using the App at any time by uninstalling it. We may restrict or terminate access if we reasonably believe you have violated these Terms or applicable law. Sections that by nature should survive (including disclaimers, limitation of liability, indemnification, and governing law) will survive termination.

12. Governing Law

These Terms are governed by applicable law in the jurisdiction where the operator of TomDown is established, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence provide otherwise.

13. Changes to These Terms

We may update these Terms from time to time. The “Effective date” at the top will change when we do. Continued use of the App after changes become effective constitutes acceptance of the revised Terms.

This Privacy Policy explains how TomDown (“we,” “us,” or “our”) handles information when you use our mobile application. It should be read together with our Terms of Service.

1. Summary

• TomDown is designed to work largely on your device (downloads, browser history, cookies, shortcuts).
• We may collect limited technical data to operate APIs, prevent abuse, and improve reliability.
• Free users may see App-level ads (Google AdMob). Premium users do not see those App-level ads.
• We use RevenueCat to validate Premium purchases; we do not receive your full payment card number.
• We do not sell your personal information.

2. Information We Collect

A) Information stored on your device

Depending on how you use TomDown, the following may be stored locally on your phone or tablet:

• Downloaded video files and related metadata (title, source URL, progress).
• Browsing history, shortcuts, and browser settings you configure.
• Cookies and cache used by the in-app browser (you can clear these in Settings).
• Language preference and other app settings.

Uninstalling the App or using clear-data options may remove some or all of this information from your device.

B) Device & app identifiers

We may generate or collect:

• A pseudonymous device identifier to associate requests with your installation (for API rate limiting, diagnostics, and support).
• App version and basic device/OS information for compatibility and crash-related diagnostics.

C) Usage & technical logs

When you use features that contact our servers (for example remote settings, media resolution, statistics, or feedback), we may process:

• IP address and request timestamps (standard server logs).
• URLs or page information you submit for download resolution (to provide the requested feature).
• Aggregated or pseudonymous usage events (e.g. feature usage counts) to maintain and improve the Service.

We use this data to operate the Service, detect abuse, and understand performance — not to build a personal profile for unrelated advertising.

D) Advertising (Google AdMob) — free users

If you have not purchased Premium, TomDown may show App-level ads (for example when opening the App). We use Google AdMob. Google and its partners may collect or receive:

• Advertising ID (GAID on Android / IDFA on iOS, where permitted).
• Device information, app interactions with ads, and approximate location derived from IP.

Where required, we use Google’s User Messaging Platform (UMP) to obtain or manage consent for personalized ads. You may also use in-app links to Privacy & ads options when available.

E) Premium purchases (RevenueCat & app stores)

When you buy or restore TomDown Premium, purchase validation is handled by Apple or Google and our subscription infrastructure partner RevenueCat. We may receive:

• Store transaction / entitlement status (whether Premium is active).
• Anonymous or pseudonymous subscriber identifiers used by RevenueCat.

We do not receive your full payment card number. RevenueCat’s privacy practices are described at revenuecat.com/privacy.

F) Feedback & support

If you contact us or submit in-app feedback, we receive the information you choose to provide (such as message text, app version, and device context) solely to respond and improve the App.

3. How We Use Information

• Provide download, browser, and file-management features.
• Resolve media URLs and deliver remote configuration.
• Verify Premium status and restore purchases.
• Display and measure App-level ads (non-Premium users).
• Secure the Service, prevent fraud and abuse, and debug errors.
• Comply with legal obligations.

4. How We Share Information

We do not sell your personal information. We may share limited data with:

• Service providers that help us run the App (hosting, analytics, ad serving, purchase validation), under contractual confidentiality and data-protection obligations.
• Apple and Google for in-app purchases and store policies.
• Authorities when required by law or to protect rights, safety, and security.

When you browse third-party websites inside TomDown, those sites may collect their own data under their privacy policies. In-browser ad blocking, when enabled, may reduce some tracking on those sites but does not control all third-party behavior.

5. Data Retention

• On-device data remains until you delete it, clear app data, or uninstall the App.
• Server logs and operational data are kept only as long as needed for security, troubleshooting, and legal compliance, then deleted or aggregated.
• Purchase entitlement records are retained as needed to honor Premium access and comply with tax/accounting rules.

6. Your Choices & Rights

Depending on your region, you may have rights to access, correct, delete, or restrict certain processing of personal information. You can:

• Clear cache, history, and cookies in TomDown Settings.
• Reset advertising IDs in your device system settings.
• Manage ad personalization via UMP / Privacy & ads options in the App.
• Upgrade to Premium to stop App-level ads.
• Email [email protected] for privacy requests.

7. Children’s Privacy

TomDown is not directed at children under 13 (or the minimum age required in your country). We do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us and we will take appropriate steps to delete it.

8. International Users

Our servers and service providers may be located in countries other than yours. By using TomDown, you understand that information may be processed in those jurisdictions, which may have different data-protection laws.

9. Security

We use reasonable technical and organizational measures to protect information we process. No method of transmission or storage is 100% secure; we cannot guarantee absolute security.

10. Changes to This Policy

We may update this Privacy Policy from time to time. The “Last updated” date will change when we do. Material changes may also be communicated in the App where appropriate.
